These terms govern the design, development and ongoing care services provided by AHS (“AHS”, “I”, “we”), a web design studio operated by Antonio Hernandez Steen, an independent professional (autónomo) registered in Spain and based in the Canary Islands. By requesting a proposal, accepting a quotation or paying a deposit, you agree to these terms.
AHS provides website design, website development, search engine optimisation groundwork, and ongoing website care and maintenance. The exact services, deliverables, page count and timeline for your project are defined in the written proposal or quotation issued to you. That proposal forms part of these terms, and where the two conflict, the proposal takes precedence.
Quotations are valid for 30 days from the date of issue unless stated otherwise. A project is confirmed once you have accepted the proposal in writing (email is sufficient) and the agreed deposit has cleared. Work does not begin before both of those things have happened.
To keep a project on schedule you agree to provide, within a reasonable time, the content, images, logos, brand assets, access credentials and approvals needed to complete the work. You confirm that you own or are licensed to use everything you supply, and that it does not infringe anyone else’s rights or break any law. Projects delayed by more than 30 days awaiting client materials may be paused and rescheduled, and a re-engagement fee may apply.
Each project includes the number of revision rounds stated in the proposal. Revisions cover refinement of the agreed design and content. Requests that introduce new pages, new functionality or a change of creative direction fall outside the agreed scope and will be quoted separately before any work is carried out.
Any timeline given is an estimate made in good faith and depends on timely feedback, content delivery and third-party services outside our control. AHS is not liable for delays caused by late client materials, hosting or domain providers, payment gateways, or other third parties.
Websites built by AHS rely on third-party products and services, which may include hosting providers, domain registrars, content management systems, plugins, themes, fonts and payment processors. These are supplied subject to their own terms and licences, and their availability, pricing and continued support are outside our control. Where a licence or subscription is purchased on your behalf, you are responsible for renewing it unless a care plan covering it is in place.
On receipt of full and final payment, ownership of the final website design and the custom code produced specifically for your project transfers to you. Excluded from that transfer are: third-party assets licensed rather than owned (plugins, themes, stock imagery, fonts), and any pre-existing tools, frameworks, components or techniques developed by AHS, which remain the property of AHS and are licensed to you on a non-exclusive basis for use in your website. AHS retains no rights over your own brand assets, content or data.
Unless you ask otherwise in writing, AHS may display your completed website, screenshots of it and a short description of the work in its portfolio, case studies and marketing material. Confidential business information is never included. AHS may place a discreet credit link in the footer of the site; this can be removed on request.
Care plans run month to month with no minimum term unless otherwise agreed, and either party may cancel with 30 days’ written notice. Fees already paid for the current month are not refundable. On cancellation, any hosting, domains, licences or mailboxes managed on your behalf will be transferred to you or to a provider of your choosing, and you become responsible for their upkeep from that point.
Either party may end a project in writing. If you terminate, deposits are non-refundable and you will be invoiced for all work completed up to the date of termination. If AHS terminates other than for non-payment or breach, you will be invoiced only for work completed and will receive the work produced to that point.
AHS will carry out its work with reasonable skill and care. Faults in the delivered build that are reported within 30 days of launch will be corrected at no charge. This does not cover changes to content or design, new features, faults caused by third-party updates, or problems arising from changes made by you or anyone else after handover. Websites are not guaranteed to be free of every defect, to be compatible with every browser or device, or to achieve any particular search ranking, traffic level or commercial result.
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, AHS is not liable for loss of profit, loss of revenue, loss of business, loss of data or any indirect or consequential loss, and its total liability arising from a project is limited to the total fees you have paid to AHS for that project.
Each party will keep confidential any non-public information disclosed by the other in the course of the work, and will use it only for the purpose of delivering or receiving the services.
Personal data is handled as described in our Privacy Policy. Where AHS processes personal data on your behalf while maintaining your website, it does so on your instructions and applies appropriate security measures.
These terms may be updated from time to time. The version published on this page at the date your proposal is accepted is the version that applies to your project.
These terms are governed by Spanish law. Any dispute that cannot be resolved amicably will be subject to the courts of Santa Cruz de Tenerife, Spain.
